PowerPix operates an online skill-based Spot the Ball competition platform. For the purposes of data protection law, PowerPix is the responsible party ("Responsible Party") in respect of your personal information.

We collect personal information that you provide to us directly, as well as information collected automatically when you use our Services.

Fraud prevention: Detecting and preventing fraudulent activity, multi-account abuse, and other prohibited conduct as set out in our Terms of Service.
Legal compliance: Fulfilling our obligations under applicable South African law, including POPIA.
Service improvement: Analysing usage patterns to improve platform functionality, competition design, and user experience.

Legal Basis for Processing

We process your personal information on the following lawful grounds under the Protection of Personal Information Act, 2013 ("POPIA") and applicable data protection law:

Contract performance: Processing necessary to perform our contract with you (e.g. running the competition, delivering prizes).
Legal obligation: Processing required to comply with applicable laws and regulations.
Legitimate interest: Processing necessary for our legitimate business interests, such as fraud prevention, platform security, and service improvement, where these are not overridden by your rights.
Consent: Where we rely on your consent — for example, marketing emails or use of winner photos — you may withdraw that consent at any time without affecting the lawfulness of processing prior to withdrawal.

Sharing Your Data

We do not sell your personal information. We may share it with:

Service providers: Third-party vendors who assist us with payment processing, cloud hosting, email delivery, analytics, and fraud detection. These parties are contractually bound to process your data only as instructed by us.
Independent judges: Our panel of judges and the legal expert overseeing the judging process receive only the entry data necessary to determine the winner.
Prize fulfilment partners: Car dealers or other prize suppliers receive only the information required to arrange prize delivery.
Legal and regulatory authorities: Where required by law, court order, or to protect the rights and safety of PowerPix or others.
Business transfers: In the event of a merger, acquisition, or sale of assets, your data may be transferred to the relevant successor entity, subject to the same protections.

Where we share your data with third parties outside of South Africa, we ensure appropriate safeguards are in place in accordance with POPIA and applicable cross-border transfer requirements.

Section 06

Data Retention

We retain your personal information only for as long as necessary to fulfil the purposes for which it was collected, including for the purposes of satisfying any legal, regulatory, tax, accounting, or reporting requirements.

Active accounts: Data is retained for the lifetime of your account plus a reasonable period thereafter.
Closed accounts: Core account and transaction records are retained for up to 5 years after account closure to comply with legal and financial obligations.
Competition records: Entry data, judging records, and winner information are retained for a minimum of 5 years following the relevant competition.
Marketing data: Retained until you opt out, after which we retain a suppression record to honour your preference.

When your data is no longer required, we securely delete or anonymise it.

Data Security

We implement appropriate technical and organisational measures to protect your personal information against unauthorised access, disclosure, alteration, or destruction. These measures include encryption of data in transit and at rest, access controls, regular security assessments, and staff training.

However, no method of transmission over the internet or electronic storage is 100% secure. While we strive to protect your data, we cannot guarantee absolute security. In the event of a data breach that poses a risk to your rights and freedoms, we will notify you and the relevant authorities in accordance with applicable law.

Under POPIA and applicable data protection law, you have the following rights in respect of your personal information:

Right of access: You may request a copy of the personal information we hold about you.
Right to correction: You may request that we correct inaccurate or incomplete information.
Right to deletion: You may request deletion of your personal information where we no longer have a lawful basis to retain it.
Right to object: You may object to processing based on legitimate interest, including direct marketing.
Right to restrict processing: You may request that we limit how we use your data in certain circumstances.
Right to data portability: Where applicable, you may request your data in a structured, machine-readable format.
Right to withdraw consent: Where processing is based on consent, you may withdraw it at any time.

Our Services are not directed to individuals under the age of 18. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a minor, please contact us immediately and we will delete it promptly.

Our platform may contain links to third-party websites or services. We are not responsible for the privacy practices or content of those third parties. We encourage you to review the privacy policies of any third-party sites you visit.

International Transfers

Some of our service providers may process your data outside of South Africa. Where such transfers occur, we ensure that appropriate safeguards are in place — such as contractual protections equivalent to those required under POPIA — to protect your information to the same standard as within South Africa.
